ಭಟ್ಕಳ: ಅರಣ್ಯ ಹಕ್ಕು ಕಾಯಿದೆ ಅಡಿಯಲ್ಲಿ ಪಾರಂಪರಿಕ ಅರಣ್ಯವಾಸಿಗಳ ಸಾಗುವಳಿ ಹಕ್ಕಿಗೆ ಮೂರು ತಲೆಮಾರಿನ ನಿರ್ದಿಷ್ಟ ವೈಯಕ್ತಿಕ ದಾಖಲೆಗೆ ಒತ್ತಾಯಿಸತಕ್ಕದ್ದಲ್ಲ. ಇಂತಹ ಪ್ರಕ್ರಿಯೆ ಕಾನೂನಿಗೆ ವ್ಯತಿರಿಕ್ತವಾಗಿದೆ ಎಂದು ರಾಜ್ಯ ಅರಣ್ಯ ಭೂಮಿ ಹಕ್ಕು ಹೋರಾಟಗಾರರ ವೇದಿಕೆಯ ಅಧ್ಯಕ್ಷ ರವೀಂದ್ರ ನಾಯ್ಕ ಹೇಳಿದರು.
ಅವರು ಇಂದು ಭಟ್ಕಳದಲ್ಲಿ ಅರಣ್ಯ ಭೂಮಿ ಹಕ್ಕು ಹೋರಾಟಗಾರರ ವೇದಿಕೆ ಆಶ್ರಯದಲ್ಲಿ ಜಿಲ್ಲಾ ಮಟ್ಟದ ಅರಣ್ಯವಾಸಿಗಳ ಕಾನೂನು ಜಾಗೃತ ಜಾಥಾಕ್ಕೆ ಚಾಲನೆ ನೀಡಿ ಮಾತನಾಡಿದರು. ಸ್ಥಳೀಯ ಉಪ ವಿಭಾಗ ಅಧಿಕಾರಿ ಕಾವ್ಯಾರಾಣಿ ಅವರ ಅನುಪ ಸ್ಥಿತಿಯಲ್ಲಿ ತಹಶೀಲ್ದಾರ ನಾಗೇಂದ್ರ ಕೆ ಎಸ್ ಅವರಿಗೆ ಮನವಿ ಮತ್ತು ಕಾನೂನು ಜಾಗೃತ ಕರಪತ್ರ ನೀಡಿ ಮಾತನಾಡಿದರು.
ಸೆಪ್ಟೆಂಬರ್ 2012 ರಲ್ಲಿಯೇ ನಿರ್ದಿಷ್ಟ ದಾಖಲೆಗಳಿಗೆ ಒತ್ತಾಯಿಸತಕ್ಕದ್ದಲ್ಲ ಎಂದು ಕಾಯಿದೆ ತಿದ್ದಪಡಿಯಾಗಿದ್ದು,ಇದಕ್ಕೆ ಪೂರಕವಾಗಿ ಗುಜಾರತ್ ಹೈ ಕೊರ್ಟ ಸಹಿತ ದಾಖಲೆಯ ಸಾಕ್ಷ್ಯ ಒತ್ತಾಯಿಸಲು ಅವಕಾಶವಿಲ್ಲವೆಂದು ಉಲ್ಲೇಖಿಸಿದೆ ಎಂದು ಅವರು ಈ ಸಂದರ್ಭದಲ್ಲಿ ಹೇಳಿದರು.
ಕೇಂದ್ರ ಸರ್ಕಾರದ ಬುಡಕಟ್ಟು ಮಂತ್ರಾಲಯದ ಆದೇಶದಲ್ಲಿ ಮಂಜೂರಿ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ ದಾಖಲೆಗಳಿಗೆ ಆಗ್ರಹಿಸಿ ಅರ್ಜಿಗಳನ್ನು ತಿರಸ್ಕರಿಸುವುದು ಸಮಂಜಸವಲ್ಲ ಎಂದು ನಿರ್ಧೇಶಿಸಿದ್ದು ಇರುತ್ತದೆ. ಅಲ್ಲದೇ, ಮೂರು ತಲೆಮಾರಿನ ಸಾಗುವಳಿ ಕ್ಷೇತ್ರದಲ್ಲಿನ ಜನವಸತಿ ಪ್ರದೇಶವೆಂದು ಪುಷ್ಠೀಕರಿಸುವುದು ಅವಶ್ಯವೆಂದು ಸ್ಪಷ್ಟಪಡಿಸಿದೆ ಎಂದು ಅವರು ಹೇಳಿದರು.
ಮಂಜೂರಿ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ ಕಾನೂನಿಗೆ ವ್ಯತಿರಿಕ್ತವಾಗಿ ಅರ್ಜಿ ಪರಿಶೀಲಿಸಲಾಗಿರುವುದರಿಂದ ರಾಜ್ಯದಲ್ಲಿ ಶೇ.೮೮.೯೦ ಅರ್ಜಿಗಳು ಹಾಗೂ ಜಿಲ್ಲೆಯಲ್ಲಿ ಶೇ ೮೩.೫೦ ಅರ್ಜಿ ತಿರಸ್ಕರಿಸ್ಪಟ್ಟಿದೆ ಎಂದು ವಿಷಾಧ ವ್ಯಕ್ತ ಪಡಿಸಿದರು. ಈ ವೇಳೆ ಜಿಲ್ಲಾ ಸಂಚಾಲಕ ಪಾಂಡುರಂಗ ನಾಯ್ಕ ಸ್ವಾಗತಿಸಿ, ಪ್ರಾಸ್ತಾವಿಕ ಮಾತನಾಡಿದರು.
ಇನ್ನೋರ್ವ ಸಂಚಾಯಕ ದೇವರಾಜ ಗೊಂಡ ವಂದಿಸಿದರು. ಜಿಲ್ಲಾ ಸಂಚಾಲಕ ಇಬ್ರಾಹೀಂ ಗೌಡಳ್ಳಿ, ರಪೀಕ್ , ನವೀನ್ ಜೈನ್, ಈಶ್ವರ ನಾಯ್ಕ ಹಾಡವಳ್ಳಿ, ಚಂದ್ರ ನಾಯ್ಕ ಬೈರೋಳೆ,ರತ್ನ ನಾಯ್ಕ ರಾಘವೇಂದ್ರ ಮರಾಠಿ, ವಿಮಲಾ ಮೋಗೇರ, ಕವಿತಾ ಮಂಜುನಾಥ ಗೋಂಡ, ನಾಗಮ್ಮ ಮೋಗೇರ, ದತ್ತ ನಾಯ್ಕ ಹಸವಳ್ಳಿ, ಸಬೀರ್, ಮೋಯೈದ್ದೀನ್, ನತ್ತಾರ, ಜಮಾವೀರ್ ಜಾಬೀರ್, ಮುಂತಾದವರು ನೇತೃತ್ವ ವಹಿಸಿದರು.
132 ಗ್ರಾ.ಪಂ ಜಾಗೃತ ಸಭೆ
ಅರಣ್ಯವಾಸಿಗಳಲ್ಲಿ ಕಾನೂನು ತಿಳುವಳಿಕೆ ನೀಡುವ ಉದ್ದೇಶದಿಂದ ಜಿಲ್ಲಾದ್ಯಂತ ೧೩೨ ಗ್ರಾಮ ಪಂಚಾಯತ್ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಕಾನೂನು ಜಾಗ್ರತ ಜಾಥಕ್ಕೆ ಸಂಭAದಿಸಿ, ಕಾರ್ಯಕ್ರಮ ಸಂಘಟಿಸಲು ನಿರ್ಧರಿಸಲಾಗಿದೆ ಇದರಿಂದ ಅರಣ್ಯವಾಸಿಗಳಲ್ಲಿ ಕಾನೂನು ಜಾಗೃತ ಮೂಡಿಸಲು ಸಾಧ್ಯವೆಂದು ಅಧ್ಯಕ್ಷ ರವೀಂದ್ರ ನಾಯ್ಕ ಹೇಳಿದರು.
ಮೂರು ಲಕ್ಷ ಕರಪತ್ರ
ಅರಣ್ಯವಾಸಿಗಳ ಕಾನೂನು ಜಾಗೃತದ ಅಂಗವಾಗಿ ನಿರ್ದಿಷ್ಟ ದಾಖಲೆಗಳ ಒತ್ತಾಯಿಸುವಿಕೆಗೆ ಅವಕಾಶವಿಲ್ಲದ ಕುರಿತು ಮತ್ತು ಸಾಗುವಳಿ ಪತ್ರಕ್ಕೆ ಸಂಬಂಧಿಸಿ ಅರಣ್ಯವಾಸಿಗಳು ಸಲ್ಲಿಸಬೇಕಾದ ೯ ದಾಖಲೆಗಳ ಪಟ್ಟಿಗಳನ್ನು ಒಳಗೊಂಡಿರುವ ಮೂರು ಲಕ್ಷ ಕರಪತ್ರವನ್ನು ವಿತರಿಸಲಾಗುವುದು ಎಂದು ಅವರು ಹೇಳಿದರು.
Forest Rights Procedure Illegal: Ravindra Naik
Bhatkal: Under the Forest Rights Act, insisting on specific personal documents for three generations to prove traditional forest dwellers’ rights over their cultivated land is unwarranted. Such a procedure is contrary to the law, said State Forest Land Rights Struggle Forum President Ravindra Naik.
He was speaking after flagging off the district-level Forest Dwellers’ Legal Awareness March organized by the Forest Land Rights Struggle Forum in Bhatkal today. In the absence of the local Assistant Commissioner Kavyarani, a memorandum and legal awareness pamphlet were submitted to Tahsildar Nagendra K.S.
He said that as early as September 2012, an amendment to the Act had clarified that insisting on specific documents was not permissible, and the Gujarat High Court too had noted that demanding such documentary proof was not allowed.
The order of the Union Ministry of Tribal Affairs also states that rejecting applications during the approval process for lack of documents is unreasonable. It further clarifies that confirming three generations of habitation in the cultivation area is sufficient evidence, he added.
Expressing concern, he said that due to the illegal scrutiny of applications during the approval process, 88.90% of applications in the state and 83.50% in the district were rejected.
At the event, district coordinator Panduranga Naik delivered the welcome and introductory address. Another coordinator, Devaraj Gonad, proposed a vote of thanks. District coordinators Ibrahim Gowdalli, Rafiq, Naveen Jain, Eshwar Naik Hadavalli, Chandra Naik Bairoli, Ratna Naik, Raghavendra Marati, Vimala Moger, Kavita Manjunath Gond, Nagamma Moger, Datt Naik Hasavalli, Sabir, Moyaiddin, Nattar, Jamaaveer Jabir and others participated.
132 Gram Panchayat Awareness Meetings
To create legal awareness among forest dwellers, programs will be organized across 132 Gram Panchayat limits in the district as part of the legal awareness march. This will help educate forest dwellers about their rights, said President Ravindra Naik.
Three Lakh Awareness Pamphlets
As part of the awareness campaign, three lakh pamphlets will be distributed. These will include information stating that insisting on specific documents is not permissible and a list of nine documents forest dwellers must submit regarding their cultivated land claims, he said.
