ಕುಮಟಾ: ಕುಮಟಾದ ಹಿರಿಯ ಸಿವಿಲ್ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ನಡೆದ ಮಹತ್ವದ ವಿಚಾರಣೆಯಲ್ಲಿ, ಕಾರವಾರ ಕೋಡಿಭಾಗದ ನಾಗವೇಣಿ ಅಶೋಕ ತಾಂಡೇಲ್ ಅವರ ವಿರುದ್ಧ ದಾಖಲಾಗಿದ್ದ ಚೆಕ್ ಬೌನ್ಸ್ ಪ್ರಕರಣ ಸಂಪೂರ್ಣ ಸುಳ್ಳಾಗಿದೆ ಎಂದು ಕೋರ್ಟ್ ಪ್ರಕರಣವನ್ನ ವಜಾಗೊಳಿಸಿದೆ. ಬಡ ಮಹಿಳೆ ಪರ ವಾದಿಸಿದ ನ್ಯಾಯವಾದಿ ವೀರೇಂದ್ರ ನಾಯಕ ತೋರ್ಕೆ ಅವರು ಮಹಿಳೆಗೆ ನ್ಯಾಯ ಸಿಗುವಂತೆ ಮಾಡಿದ್ದಾರೆ..
ಪ್ರಕರಣದ ಹಿನ್ನೆಲೆ
ನಾಗವೇಣಿ ಅವರ ಪತಿಗೆ ಓಪನ್ ಹಾರ್ಟ್ ಶಸ್ತ್ರಚಿಕಿತ್ಸೆ ಅಗತ್ಯವಿದ್ದ ಸಂದರ್ಭದಲ್ಲಿ ಮಹಿಳಾ ಸಂಘದ ಮೂಲಕ ಸಾಲ ಪಡೆಯಲು ಅವರು ‘ಬ್ಲ್ಯಾಂಕ್ ಚೆಕ್’ ಒಂದನ್ನ ಕಾರವಾರದ ಆಶಾ ಕೇಶವ ನಾಯ್ಕ ಅವರಿಗೆ ನೀಡಿದ್ದರು. ಆದರೆ ಶಸ್ತ್ರಚಿಕಿತ್ಸೆಯ ಸಂಪೂರ್ಣ ವೆಚ್ಚ ಆಯುಷ್ಮಾನ್ ಯೋಜನೆಯ ಮೂಲಕ ಸರ್ಕಾರವೇ ಭರಿಸಿದ್ದರಿಂದ ಸಾಲದ ಅಗತ್ಯವೇ ಇರಲಿಲ್ಲ. ಇದನ್ನೇ ಅಸ್ತ್ರವಾಗಿ ಬಳಸಿಕೊಂಡ ಆಶಾ ನಾಗವೇಣಿ ತನ್ನ ಪತಿಯ ಚಿಕಿತ್ಸೆಗೆ ಹಣ ಕೇಳಿ 7 ಲಕ್ಷ ರೂ. ಪಡೆದರೂ ಅದನ್ನು ಹಿಂದಿರುಗಿಸದೆ ವಂಚನೆ ಮಾಡಿದ್ದಾರೆಂದು 2023ರಲ್ಲಿ ನಾಗವೇಣಿ ಅವರ ವಿರುದ್ದ.ಕುಮಟಾದ ಹಳೇ ಮೀನುಮಾರುಕಟ್ಟೆಯ ಸಂದೇಶ ರಾಮಾ ಅಂಬಿಗ ಎಂಬ ವ್ಯಕ್ತಿಯ ಮೂಲಕ ಕುಮಟಾದ ಹಿರಿಯ ಸಿವಿಲ್ ಕೋರ್ಟ್ನಲ್ಲಿ ಪ್ರಕರಣ ದಾಖಲಿಸಿದ್ದರು.
ಸಂದೇಶ ಅಂಬಿಗ ನೀಡಿದ ಸುಳ್ಳು ಪ್ರಕರಣದಲ್ಲಿ, ನಾಗವೇಣಿ ಎಂಬಾಕೆ ತನ್ನ ಪತಿಯ ಹಾರ್ಟ್ ಸರ್ಜಿರಿ ಮಾಡಿಸಲು ತನ್ನಲ್ಲಿ 8 ಲಕ್ಷ ರು. ಕೇಳಿದ್ದಳು. ತಾನು 7 ಲಕ್ಷ ರು. ಹಣವನ್ನು ನೀಡಿ, ಶ್ಯೂರಿಟಿಗಾಗಿ ಚೆಕ್ ನೀಡಿದ್ದರು. ಆದರೆ ಪಡೆದ ಹಣವನ್ನು ವಾಪಸ್ ನೀಡದೆ ವಂಚಿಸಿದ್ದಾರೆ. ಪಡೆದ 7 ಲಕ್ಷ ರು. ಹಣದಲ್ಲಿ ಕೇವಲ 10 ಸಾವಿರ ರು. ಮಾತ್ರವೇ ವಾಪಸ್ ನೀಡಿದ್ದಾರೆ. ಉಳಿದ 6.90 ಲಕ್ಷ ರು.ಗಳನ್ನು ವಾಪಸ್ ಕೊಡಿಸುವಂತೆ ಕೋರ್ಟ್ ಬಳಿ ಸಂದೇಶ ಅವರು ಮನವಿ ಮಾಡಿದ್ದರು. ಈ ಪ್ರಕರಣದ ವಾದ-ಪ್ರತಿವಾದ ಆಲಿಸಿದ ಹಿರಿಯ ಸಿವಿಲ್ ನ್ಯಾಯಾಧೀಶರಿಗೆ ಇದೊಂದು ಸುಳ್ಳು ಚೆಕ್ ಬೌನ್ಸ್ ಪ್ರಕರಣ ಎಂಬುದು ಸಾಕ್ಷಿಗಳ ವಿಚಾರಣೆ ವೇಳೆಯಲ್ಲಿ ಸಾಬೀತಾಗಿದೆ.
ನಾಗವೇಣಿ ಪತಿ ಅವರಿಗೆ ಓಪನ್ ಹಾರ್ಟ್ ಸರ್ಜರಿ ಆಗಿದ್ದು ನಿಜ. ಆದರೆ ಸರ್ಜರಿಯ ಒಟ್ಟು ಹಣವನ್ನು ಸರ್ಕಾರದ ಆಯುಷ್ಮಾನ್ ಕಾರ್ಡ್ ಮೂಲಕ ಭರಿಸಲಾಗಿದೆಯೇ ಹೊರತು ಆಸ್ಪತ್ರೆಯಲ್ಲಿ ಯಾವುದೇ ಹಣವನ್ನು ನೀಡಿಲ್ಲ ಎಂಬುದು ದೃಢಪಟ್ಟಿದೆ. ಹಣ ಕೊಟ್ಟ ಬಗ್ಗೆ ಸಾಕ್ಷಿ ಸಮೇತ ರುಜುವಾತು ಮಾಡಲು ಸಾಧ್ಯವಾಗದ ಕಾರಣ ಇದು ಸುಳ್ಳು ಚೆಕ್ ಬೌನ್ಸ್ ಪ್ರಕರಣ ಎಂದು ಹಿರಿಯ ಸಿವಿಲ್ ನ್ಯಾಯಾಧೀಶರಾದ ಭಾರತಿ ಎಸ್. ರಾಯಣ್ಣನವರ್ ಪ್ರಕರಣವನ್ನು ವಜಾಗೊಳಿಸಿ ನಾಗವೇಣಿ ಅವರ ವಿರುದ್ಧ ಇದ್ದ ಆರೋಪಗಳನ್ನು ಖುಲಾಸೆಗೊಳಿಸಿದ್ದಾರೆ.
ನಾಗವೇಣಿ ಅವರ ಪರವಾಗಿ ಗೋಕರ್ಣದ ನ್ಯಾಯವಾದಿ ವೀರೇಂದ್ರ ಗಿರಿಯಣ್ಣ ನಾಯಕ ತೊರ್ಕೆ ಅವರು ಅತ್ಯುತ್ತಮವಾಗಿ ವಾದ ಮಂಡಿಸಿ, ಬಡ ಮಹಿಳೆಗೆ ನ್ಯಾಯ ಕೊಡಿಸಿದ್ದಾರೆ.
Kumta: In a significant hearing at the Kumta Senior Civil Court, the court dismissed a cheque bounce case filed against Nagaveni Ashok Tandel of Kodibag, Karwar, declaring it completely false. Advocate Veerendra Giriyanna Nayak Torke, who represented the poor woman, ensured that she received justice.
Background of the Case
When Nagaveni’s husband required an open-heart surgery, she had approached a women’s association for financial help and had handed over a blank cheque to Asha Keshav Naik of Karwar.
However, the entire cost of the surgery was covered under the government’s Ayushman Health Scheme, and she did not have to take any loan. Using this situation as an opportunity, Asha allegedly misused the blank cheque.
In 2023, through one Sandesh Rama Ambiga of the old fish market area in Kumta, Asha filed a false case in the Kumta Senior Civil Court claiming that Nagaveni had borrowed ₹7 lakh for her husband’s surgery and failed to return it.
Details of the False Case
In the complaint filed by Sandesh Ambiga, it was alleged that Nagaveni had asked him for ₹8 lakh for her husband’s heart surgery.
He claimed to have lent her ₹7 lakh and that she had given a cheque as security. He further alleged that she repaid only ₹10,000 and failed to return the remaining ₹6.9 lakh.
During the hearing, the Senior Civil Judge found that all these allegations were false. Evidence revealed that:
Nagaveni’s husband did undergo open-heart surgery. The entire cost was paid by the government through the Ayushman card. No payment was made by the family to the hospital. There was no evidence to prove that any money was lent to Nagaveni.
Since the complainant failed to produce credible proof, the court concluded that the cheque bounce case was fabricated.
Senior Civil Judge Bharti S. Rayannanavar therefore dismissed the case and acquitted Nagaveni of all charges.
