ಕುಮಟಾ: 2023ರ ಕರ್ನಾಟಕ ವಿಧಾನಸಭಾ ಚುನಾವಣೆಯಲ್ಲಿ 673 ಮತಗಳ ಅಂತರದಲ್ಲಿ ಜಯಗಳಿಸಿದ್ದ ಕುಮಟಾ-ಹೊನ್ನಾವರ ಕ್ಷೇತ್ರದ ಬಿಜೆಪಿ ಶಾಸಕ ದಿನಕರ ಶೆಟ್ಟಿಯವರ ಗೆಲುವಿಗೆ ಹೈಕೋರ್ಟ್ ಮುದ್ರೆ ಬಿದ್ದಿದೆ.
ಜೆಡಿಎಸ್ ಅಭ್ಯರ್ಥಿ ಸೂರಜ್ ನಾಯ್ಕ ಸೋನಿ, ಮತ ಎಣಿಕೆಯಲ್ಲಿ ಅಕ್ರಮ ನಡೆದಿದೆ ಎಂದು ಆರೋಪಿಸಿ ಕಾನೂನು ಹೋರಾಟ ಆರಂಭಿಸಿದ್ದರು. ಆದರೆ, ಹೈಕೋರ್ಟ್ ಈ ಪ್ರಕರಣದಲ್ಲಿ ಸಾಕ್ಷ್ಯಾಧಾರಗಳ ಕೊರತೆ ಕಂಡು, ಸೂರಜ್ ನಾಯ್ಕ ಸೋನಿಯವರು ದಾಖಲಿಸಿದ್ದ ಅರ್ಜಿಯನ್ನು ಖುಲಾಸೆಗೊಳಿಸಿ, ದಿನಕರ ಶೆಟ್ಟಿಯವರ ಗೆಲುವನ್ನು ದೃಢಪಡಿಸಿದೆ.
ಚುನಾವಣಾ ಫಲಿತಾಂಶ
2023ರ ಚುನಾವಣೆಯಲ್ಲಿ ದಿನಕರ ಶೆಟ್ಟಿಯವರು 59,966 ಮತಗಳನ್ನು ಪಡೆದು, ಸೂರಜ್ ನಾಯ್ಕ ಸೋನಿ ಅವರ 59,293 ಮತಗಳ ವಿರುದ್ಧ ಕೇವಲ 673 ಮತಗಳ ಅಂತರದಲ್ಲಿ ಗೆದ್ದಿದ್ದರು. ಪ್ರಾರಂಭಿಕ ಸುತ್ತಿನಲ್ಲಿ ಬಿಜೆಪಿ ಮತ್ತು ಜೆಡಿಎಸ್ ನಡುವೆ ಕಠಿಣ ಸ್ಪರ್ಧೆ ನಡೆಯುತ್ತಿದ್ದರೆ, 14ನೇ ಹಾಗೂ 15ನೇ ಸುತ್ತಿನಲ್ಲಿ ಜೆಡಿಎಸ್ ಮುನ್ನಡೆ ಸಾಧಿಸಿತ್ತು. ಜೆಡಿಎಸ್ ಕಾರ್ಯಕರ್ತರು ಸಂಭ್ರಮಾಚರಣೆಗೆ ಸಿದ್ಧವಾಗುತ್ತಿದ್ದ ವೇಳೆಯಲ್ಲಿ, ಎರಡು ಮತಯಂತ್ರಗಳಲ್ಲಿ ತಾಂತ್ರಿಕ ತೊಂದರೆ ಕಂಡುಬಂದ ಕಾರಣದಿಂದ ವೋಟಿಂಗ್ ಸ್ಲಿಪ್‌ಗಳನ್ನು ಮರು ಎಣಿಕೆ ಮಾಡುವ ಅಗತ್ಯವಾಯಿತು. ಇದರಿಂದ ಫಲಿತಾಂಶ ಘೋಷಣೆಯಲ್ಲಿ ವಿಳಂಬ ಉಂಟಾಗಿ, ಜೆಡಿಎಸ್ ಬೆಂಬಲಿಗರು ಅಸಮಾಧಾನ ವ್ಯಕ್ತಪಡಿಸಿದ್ದರು. ಇದೇ ವಿಚಾರವನ್ನು ಅಕ್ರಮ ಎಂದು ಬಿಂಬಿಸಿ, ಸೂರಜ್ ನಾಯ್ಕ ಸೋನಿ ಕೋರ್ಟ್ ಮೆಟ್ಟಿಲೇರಿದ್ದರು.
ಹೈಕೋರ್ಟ್ ತೀರ್ಮಾನ
ನ್ಯಾಯಾಲಯವು ಎಲ್ಲಾ ದಾಖಲೆಗಳನ್ನು ಪರಿಶೀಲಿಸಿದ ಬಳಿಕ, ಮತ ಎಣಿಕೆಯಲ್ಲಿ ಯಾವುದೇ ಅಕ್ರಮ ನಡೆದಿಲ್ಲ ಎಂದು ಸ್ಪಷ್ಟಪಡಿಸಿದೆ. ಜೊತೆಗೆ, ಸೂರಜ್ ನಾಯ್ಕ ಸೋನಿ ಅವರ ಅರ್ಜಿಯನ್ನು ತಿರಸ್ಕರಿಸಿ, ಪ್ರಕರಣವನ್ನು ಖುಲಾಸೆಗೊಳಿಸಿದೆ. ಇದರೊಂದಿಗೆ ದಿನಕರ ಶೆಟ್ಟಿಯವರ ಶಾಸಕರ ಸ್ಥಾನ ಇನ್ನಷ್ಟು ಬಲವತ್ತಾಗಿದೆ.
ಹಿಂದಿನ ಅನುಭವ
ದಿನಕರ ಶೆಟ್ಟಿ ರಾಜಕೀಯ ಜೀವನದಲ್ಲಿ ಮೂರು ಬಾರಿ ಶಾಸಕರಾಗಿದ್ದು, ಎರಡು ಬಾರಿ ಬಿಜೆಪಿ ಹಾಗೂ ಒಂದು ಬಾರಿ ಜೆಡಿಎಸ್‌ನಿಂದ ಗೆಲುವು ಸಾಧಿಸಿದ್ದಾರೆ.
ಹಿಂದೆ ಜೆಡಿಎಸ್‌ನಿಂದ ಸ್ಪರ್ಧಿಸಿ ಕಾಂಗ್ರೆಸ್‌ನ ಮಾಜಿ ಶಾಸಕ ದಿ. ಮೋಹನ ಶೆಟ್ಟಿಯನ್ನು ಕೇವಲ 20 ಮತಗಳ ಅಂತರದಿಂದ ಸೋಲಿಸಿದ್ದ ದಿನಕರ ಶೆಟ್ಟಿಯವರ ಗೆಲುವನ್ನು ಆ ಸಮಯದಲ್ಲಿಯೂ ನ್ಯಾಯಾಲಯ ದೃಢಪಡಿಸಿತ್ತು.
ಜನರಲ್ಲಿ ಗೊಂದಲಕ್ಕೆ ತೆರೆ
ಈ ಬಾರಿ ಹೈಕೋರ್ಟ್ ತೀರ್ಪಿನಿಂದ ಕಳೆದ ಎರಡುವರೆ ವರ್ಷಗಳಿಂದ ಜನರಲ್ಲಿ ಹರಿದಾಡುತ್ತಿದ್ದ ಅನುಮಾನಗಳು, ಊಹಾಪೋಹಗಳು ಹಾಗೂ ಗೊಂದಲಗಳಿಗೆ ತೆರೆ ಬಿದ್ದಂತಾಗಿದೆ.
ಈ ತೀರ್ಮಾನದಿಂದ ದಿನಕರ ಶೆಟ್ಟಿಯವರು ಜನಪ್ರತಿನಿಧಿಯಾಗಿ ಮತ್ತೊಮ್ಮೆ ಜನಾನುರಾಗಿಗಳೆಂಬುದನ್ನು ಸಾಬೀತುಪಡಿಸಿದ್ದಾರೆ.

Kumta: The Karnataka High Court has upheld the victory of BJP MLA Dinkar Shetty, who won the 2023 Karnataka Assembly elections from the Kumta-Honnavar constituency by a narrow margin of 673 votes.
Legal Challenge by JD(S) Candidate
JD(S) candidate Suraj Naik Soni had filed a petition challenging the election results, alleging irregularities during the vote counting process. However, after reviewing all evidence, the High Court dismissed the petition, citing a lack of substantial proof, and confirmed Dinkar Shetty’s win.
Tight Contest in 2023 Elections
In the 2023 polls, Dinkar Shetty secured 59,966 votes, narrowly defeating Suraj Naik Soni, who received 59,293 votes.
The contest witnessed a close fight between the BJP and JD(S), with JD(S) gaining the lead in the 14th and 15th rounds of counting.
JD(S) supporters even began celebrations, anticipating a win. However, technical glitches in two Electronic Voting Machines (EVMs) led to a re-counting of VVPAT slips, causing a delay in the announcement of the final results.
JD(S) workers expressed displeasure over the delay, which later became the basis for Suraj Naik Soni’s legal challenge.
High Court Verdict
After thorough examination of records and procedures, the High Court ruled that no irregularities occurred during the counting process and dismissed the case. This verdict further strengthens Dinkar Shetty’s position as the elected representative of the constituency.
Past Political Record
Dinkar Shetty has been elected as an MLA three times — twice as a BJP candidate and once representing JD(S).
In an earlier election, he had defeated former Congress MLA Di. Mohan Shetty by a razor-thin margin of 20 votes, a result that was also upheld by the court at the time.
